From now on, we can refer to our application as «App», «Application» or simply, «LactApp».
Why do we have this Privacy Policy?
From LactApp we want to offer the user a service that is as safe and reliable as possible, informing them in detail about what we do when we collect their information and how we treat it. Therefore, we have developed and implemented this privacy and cookie policy in our company and mobile application to inform you that we guarantee compliance with the security measures required by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, regarding the protection of individuals with regard to the processing of personal data and the free circulation of these data, Organic Law 15/1999, of 13 December, on Data Protection (hereinafter, LOPD), Royal Decree 1720/2007, of 21 December, having proceeded to the corresponding declaration of files before the Spanish Data Protection Agency; as well as complying with the provisions of Law 34/2002 of July 11, information society and electronic commerce, regarding the installation of cookies (hereinafter, LSSICE).
Guiding principles of the Privacy Policy
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the guiding principles of this Data Policy will be those of lawfulness, fairness and transparency, purpose limitation, data minimisation (adequacy and relevance), accuracy, limitation of storage time, integrity and confidentiality, as well as proactive liability.
That is to say, we only collect the data necessary for the performance of our activity, deleting them beyond the time necessary or legally established in relation to their specific purpose. The treatment that we carry out is transparent and honest, being able to exercise your rights with respect to the same at any time.
How do we collect your data?
a) Through the registration channel
For registration we collect your email address or your Facebook profile, as you choose, and you can optionally collect your mobile phone.
b) Through our App
Once you register, within our App, we collect the following information and for the following purposes:
From the mother, we collect the following data:

Date of birth
Status (pregnancy)
City
Probable date of delivery, if applicable
Number of children
E-mail address
From the babies, we collect first name, sex, date of birth, weights and sizes reached, as well as other related information such as number of bowel movements.
For safeguarding reasons all chat interactions are recorded and internally monitored by different members of our professional chat service team of lactation consultants, midwifes, psychologists, pediatricians and trained infant feeding experts.
The user can at any time modify their information or data through their profile within the application.
c) Through contact mail and/or Social Networks
The user can also contact LactApp, if desired through a contact email: hola@lactapp.es or you can also contact our team, through our Facebook profile.
All this data will be stored in a secure server at Amazon, outside the app. And all the communication between the server and the app is made over HTTPS so it is TLS encrypted.
Why do we collect data from the user?
The information indicated in point 4 above is collected and processed by LactApp for six reasons or for six purposes:
Warn the user that at any time, they can modify or delete their information or data through their profile within the application.
With respect to the information collected through email or social networks, we will use it to respond to what the user has indicated in their email or message, as well as to carry out the requested service, where appropriate.
Products section
Within LactApp there is a differentiated section where different products are proposed as well as discount coupons. As specified in the following section, you must give your prior express consent to access it but even if you decide not to do so your ability to use the other features of the application will not be affected.
Mailing list to receive your own commercial information
Only if you give us your prior express consent to receive your own commercial information will we include your e-mail address in the corresponding database.
At any time you can exercise your rights in relation to the same (described in the following point), including the deletion, ie stop receiving these emails with commercial information itself.
It is possible that these emails are addressed to specific groups of users according to the age of their babies, if this information has been provided.
Chat
LactApp offers the functionality of a chat where you can make specific queries about breastfeeding. Our data protection policy also applies to chat.
Some users send us images through the chat in connection with your queries. Sometimes LactApp participates in study and research projects related to breastfeeding and its possible pathologies and associated problems.
We will only use the images you send us for study, research and training projects with your express consent. This will be collected beforehand and all the corresponding information has been provided.
What other formalities do we take into account?
We require express consent
In order to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and with the Organic Law on Data Protection, we expressly require the consent of the user. By virtue of this, by accepting our notices and policies in the spaces indicated for this purpose in our application, you expressly authorise us to process your personal data, in accordance with the purposes set out in this policy, that is, to be able to provide you with the service requested, to keep you up to date with our services and new functionalities or updates of the application and studies on the use of the application, as well as with the express consent of the possibility of using them in studies, research or training.
When you fill in the registration form or register in our application as a user, write to us at the contact email or through social networks, you will freely and unequivocally accept the boxes that appear at the end of each form, if any, or registration, in which you will state that you give us your express consent. In short, it means that you authorize us to treat your data in accordance with the aforementioned purpose.
We also ask for your express consent to send your own commercial information, with news and/or information that we think may be of interest to you.
Age of majority
As indicated in the Legal Notice, for the download and/or use of our application, it is necessary that you are of legal age or that you are older than 14 years and younger than 18 years but have the consent of your parents or guardians for it.
We guarantee your rights of access, rectification, limitation of the treatment, suppression and opposition of personal data.
At any time and when you consider it convenient, you can make use of your rights of access, rectification, limitation of the treatment, suppression and opposition. In both cases, it is essential that you attach a copy of the passport or ID (holder of the data) and indicate in the subject, expressly, the request you want to make: access, rectification, limitation of treatment, deletion or opposition. If you have any doubt about how to do this, please contact our team beforehand and we will tell you the steps to be taken.
In accordance with current legislation, we will reply to your request within one month of receipt. This period may exceptionally be extended for a further two months depending on the complexity and number of requests. In this case you will be informed of the reasons for the delay.
In the event that your application is not processed or you are not in agreement with our way of acting, you have the possibility of submitting a complaint to the corresponding Data Protection Agency.
Security measures in the collection of data
In our application we ensure the security of information and therefore, we use security systems that allow us to maintain the integrity and confidentiality of data collected throughout the process of collecting and processing them.
However, it is necessary for you to understand that Internet security measures are not impregnable and that, therefore, you are obliged to adopt the necessary security measures that correspond to you, apart from introducing certain and reliable data about you and your person, as well as watching over what affects you and corresponds to you, for the security of your information.
Our company, on our side, will proactively try to guarantee your privacy and security at all times, always using the utmost diligence and implementing the appropriate measures.
Although, for example, as a user you are solely responsible for the security measures you adopt in relation to the protection of your password or user. In this sense, LactApp is not responsible for situations where you have not adopted or implemented sufficient security measures. Nor is LactApp responsible for the consequences of this, nor for causes or damages caused by third parties outside this company, nor for reasons of force majeure.
LactApp’s presence on Social Networks
As mentioned before, LactApp has a corporate profile on Google+, Twitter, Facebook and Instagram. In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and Organic Law 15/1999 of 13 December on data protection, we are responsible for the processing of your data as a user/follower of our profile within these networks. In order to do so, it is necessary that we inform you about how we will process your data from or through these social networks, which we inform you about below.

Other monitoring systems
We inform you that in order to offer you the best service according to your movements or queries in the App, we also have a record of the activity of the user in the application itself. In accordance with the LSSICE, it is necessary that our users are informed prior to navigation through the application and its functionalities of the use, type and purpose of cookies.
