CONSENT FOR THE TRANSFER OF IMAGE AND AUDIOVISUAL MATERIAL RIGHTS
1. Introduction
In LactApp we work to support mothers with their breastfeeding trying to always offer true and contrasted information, support and the experience of our team of experts and consultants in breastfeeding. And we want to do it using the possibilities that technology offers us in order to reach more mothers around the world every day.
In a declarative but not exclusive way, we develop our work through our mobile application «LactApp», our blog (https://blog.lactapp.es/), our website (https://lactapp.es/) and our different official profiles in social networks; and developing projects such as LactAppClínic, LactAppShop, the postgraduate course of University Expert in Breastfeeding and several scientific studies related to breastfeeding.
2. Parts
I, from now on «the participant», confirm that I am of legal age and that I have all image and authorship rights of the audiovisual material (photographs, videos and audios) and other materials (texts, stories, personal experiences, samples, data, etc.), from now on «the assigned material», that I will transfer to LactApp Women Health, SL with NIF number: B66777780 and address in Barcelona, calle Valencia, 263, 3º 1ª, from now on LactApp. Below are the conditions of the contract of transfer of rights.
Additionally, I confirm that I have the express and unequivocal consent of transfer by verbal or written agreement of any other person whose data and / or rights may appear or be identified in the material transferred. In the event that minors appear in the material, I confirm that I also have the express and unequivocal consent of those who represent or have legal guardianship over them.
3. Purpose of the transfer of the "transferred material"
The purpose of the disinterested cession of the material given by the participant is that LactApp can use this material to carry out any of its activities, present or future, in relation to its work of support to the mothers, study, diffusion and improvement of the breastfeeding in our society.
4. Exclusions and Limitations
LactApp will not be able to sell or give to third parties the assigned material in any case. LactApp will not be able to use the material in any project or agreement that implies an economic compensation for the material. This material can never be commercialized by LactApp or any other person or company.
5. Economic conditions
The transfer of all the material provided by the participant to LactApp does not imply any economic compensation in favor of the participant neither at the time of the transfer nor in the future. In addition, and with the aim of clarifying these terms, the participant expressly waives any consideration or financial compensation that may arise from any right of its own or associated with the transferred material.
6. Geographic scope and duration of the assignment of rights
The assignment, and therefore the use of the assigned material, has no determined geographical scope so LactApp will be able to use it in all countries of the world without geographical limitation of any kind.
All this with the only exception and limitation of those uses or applications that could violate the right to honor in the terms provided in the Organic Law 1 / 85 of May 5, Civil Protection to the Right to Honor, Personal and Family Privacy and the Own Image.
The present assignment of rights does not also set any time limit for its use, so the assignment is considered granted for an unlimited period of time, although it can always be revoked by the participant at any time.
7. Revocation of the assignment
In case the participant communicates in writing to LactApp that she wants to revoke the transfer of all or part of the material transferred; or in case a third person appears as the owner of any right over the material and wants to revoke the cession, LactApp commits to remove the material from its internal files, not to use it in any project from the date of communication of the revocation and to remove it from those physical and virtual spaces of which LactApp is the only owner and has the power and technical capacity to remove the material; that is (its website, its blog and its App). On the contrary, LactApp can not be responsible, although it is committed to try, to remove the material in question from other websites and other virtual domains that are not owned by LactApp such as social networks, web pages and / or appearance in search engines controlled by third parties or companies.
8. Acceptance
By accepting this notice, I expressly authorize LactApp to process and use this data (transferred material) in accordance with the purposes set out above.
At the moment of sending, I accept that I give my express consent in a free and unmistakable way.
9. Jurisdiction
The Parties, for the interpretation and execution of the present Consent of participation and cession of rights, with resignation to their own jurisdiction if they had it, are expressly submitted to the Courts and Tribunals of the city of Barcelona, Spain.
